General Terms and Conditions of VegaQura

Article 1 – Definitions.

In these terms and conditions, the following definitions shall apply:

  • Reflection period: the period within which the consumer can exercise his right of withdrawal.
  • Consumer: the natural person not acting in the exercise of a profession or business who enters into a distance contract with the entrepreneur.
  • Day: calendar day.
  • Duration transaction: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time.
  • Durable medium: any means by which the consumer or entrepreneur can store information in a way that allows future consultation and unaltered reproduction.
  • Right of withdrawal: the possibility for the consumer to waive the distance contract within the cooling-off period.
  • Entrepreneur: VegaQura, the legal entity offering products and/or services to consumers at a distance.
  • Distance contract: an agreement which, up to and including the conclusion of the contract, makes exclusive use of techniques for distance communication.

Article 3 – Applicability.

  1. These general terms and conditions apply to any offer by the entrepreneur and to any distance contract concluded between entrepreneur and consumer.
  2. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not possible, it will be indicated where the conditions can be found and that they will be sent free of charge upon request.
  3. In case of contradiction between specific product or service terms and these general terms and conditions, the provision most favorable to the consumer shall prevail.

Article 4 – The offer

  1. The offer contains a complete and accurate description of the products and/or services offered. Images are a true representation.
  2. Obvious errors or mistakes in the offer do not bind the entrepreneur.
  3. Each offer contains clear information about the price (including taxes), any shipping costs, and the rights and obligations associated with acceptance of the offer.

Article 5 – The Agreement

  1. The agreement is established at the moment of the consumer’s acceptance of the offer and fulfillment of the conditions set.
  2. If the agreement is concluded electronically, the entrepreneur shall ensure appropriate technical and organizational measures to secure electronic data transmission.
  3. The entrepreneur immediately acknowledges receipt of acceptance of the offer.
  4. The operator reserves the right to refuse an order or impose additional conditions in the event of suspected abuse.

Article 6 – Right of withdrawal

  1. The consumer has the right to revoke the contract within 60 days of receiving the product without giving reasons.
  2. During the cooling-off period, the consumer should handle the product and its packaging with care. The product should be unpacked or used only as necessary to determine its nature, characteristics and operation.
  3. For revocation, consumers should contact at info@vegaqura.com and use the model form or other clear statement.

Article 7 – Costs in case of withdrawal

  1. Return shipping costs are the responsibility of the consumer.
  2. The entrepreneur will refund the full purchase price, including any standard shipping costs, within 14 days of receiving the returned product.

Article 8 – Exclusion of the right of withdrawal.

  1. The right of withdrawal may be excluded for products that:
    • May spoil quickly or have a limited shelf life.
    • Not suitable for return shipment for hygienic reasons when the seal is broken.

Article 9 – The price

  1. Prices listed include VAT.
  2. Obvious errors in pricing do not bind the entrepreneur.

Article 10 – Conformity and warranty

  1. The entrepreneur guarantees that the products meet the agreement, the specifications in the offer, and reasonable requirements of soundness and/or usability.
  2. Any complaints of defects must be reported in writing within 14 days of discovery.

Article 11 – Delivery and execution

  1. The entrepreneur will take the utmost care in processing and shipping orders.
  2. Delivery is made to the address provided by the consumer.
  3. If a product cannot be delivered on time, the consumer will be notified within 30 days and has the right to cancel the agreement free of charge.

Article 12 – Duration transactions: duration, termination and renewal

  1. The consumer may terminate an open-ended contract at any time with one month’s notice.
  2. Fixed-term contracts may be terminated by the end of the term.

Article 13 – Payment

  1. Payments must be made by the deadline.
  2. In case of non-payment, the entrepreneur reserves the right to charge reasonable costs.

Article 14 – Complaints procedure

  1. Complaints about the performance of the agreement must be reported in writing within 7 days of discovery via info@vegaqura.com.
  2. The entrepreneur will answer complaints within 14 days of receipt.

Article 15 – Disputes

  1. Contracts between the entrepreneur and the consumer are exclusively governed by Dutch law.

Article 16 – Additional or different provisions

  1. Additional provisions must not be to the detriment of the consumer and must be in writing.
